Terms and Conditions — Dear Pet

1. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service. If you are under the age of majority where you live, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

The Service is offered worldwide, subject to applicable law and app store availability. You are responsible for compliance with local laws.

2. The Service

Dear Pet is a family-friendly application that lets you upload a photo of a pet and receive a short AI-generated video. Features may include:

• Anonymous device-based accounts (no email registration required).
• Credit-based video generation and/or subscription plans (weekly, monthly, and credit products) sold through Google Play.
• Optional analytics to improve stability and performance.

We may add, change, or remove features at any time. The Service is provided on an “as is” and “as available” basis without uptime or availability guarantees.

3. Account and access

3.1 Device-based credentials

When you first use the app, the Service creates an anonymous account tied to a secret identifier stored on your device. You are responsible for safeguarding that identifier.

There is no password recovery or account restoration if you lose access to your device credentials (for example after uninstalling the app and clearing app data without your own backup). We are not liable for loss of access, credits, or subscription entitlements in that situation.

3.2 Accurate use

You agree to use the Service only through the official Dear Pet app distributed via Google Play (dev.honami.dearpet) and not to circumvent technical limits, security measures, or billing systems.

4. Purchases, subscriptions, and billing

4.1 Google Play

All in-app purchases (including credit products, weekly subscriptions, and monthly subscriptions) are processed by Google Play. By purchasing, you also agree to Google Play’s terms and policies.

• Prices displayed in the app are tax-inclusive where applicable; Google calculates and remits applicable taxes.
• Subscriptions renew automatically until you cancel through your Google Play account settings.
• Cancellation must be done via Google Play; uninstalling the app does not cancel a subscription.
• Refunds are handled according to Google Play’s refund policies; we do not provide separate refund rules beyond what Google offers.

4.2 Entitlements and fair use

Credits and subscription benefits are tied to your account as validated by our servers and Google Play records.

Subscriptions may include fair-use limits per billing period (a maximum number of video generations during the current subscription period). If you exceed fair use, you may be unable to start new paid jobs until the next period or until you purchase credits, as described in the app.

We may adjust product definitions, fair-use limits, and pricing in the app store in accordance with Google Play rules and applicable law.

4.3 Chargebacks and fraud

We may suspend or terminate access if we detect fraudulent purchases, chargebacks, abuse of billing systems, or violations of these Terms.

5. User content and acceptable use

5.1 Your content

You may upload pet photos and provide text such as a pet name and description. You retain ownership of content you upload and of videos generated for you.

Subject to these Terms, we grant you a broad license to use, share, and exploit your generated videos for any lawful purpose, including personal and commercial use, provided you respect third-party rights (for example, do not misrepresent ownership of someone else’s pet or likeness).

5.2 License to us

To operate the Service, you grant Honami a non-exclusive, worldwide, royalty-free license to host, process, transmit, and display your content solely to provide and improve the Service, enforce these Terms, and comply with law. This includes sending images and prompts to third-party AI providers as described in our Privacy Policy.

This license ends when we delete your content in accordance with our retention practices, except where retention is required by law or legitimate backup/archival cycles.

5.3 Prohibited content and conduct

You agree not to upload, generate, or attempt to generate content that:

• Is illegal or promotes illegal activity.
• Is sexually explicit (NSFW) or otherwise inappropriate for a general audience.
• Does not primarily depict a pet (or other permitted animal subject) — for example, landscapes-only, objects-only, or unrelated human-focused images intended to bypass pet detection.
• Infringes intellectual property, privacy, or publicity rights of others.
• Contains malware or is designed to disrupt the Service.
• Attempts to reverse engineer, scrape, or overload our systems.

We may refuse, remove, or fail jobs that violate these rules and may suspend accounts involved in repeated or serious violations.

5.4 AI-generated output

Videos are produced by automated AI systems. Outputs may be inaccurate, low quality, unexpected, or fail to match your photo or description. We do not guarantee any particular aesthetic or technical result. You use generated videos at your own risk.

6. Intellectual property

The Service, including software, branding, and documentation (excluding your content and your generated videos), is owned by Honami or its licensors and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or brand except as needed to use the Service.

If you believe content on the Service infringes your rights, contact contact@dearpet.app with sufficient detail for us to review.

7. Privacy

Our collection and use of personal data is described in the Privacy Policy. By using the Service, you acknowledge that policy.

8. Suspension and termination

We may suspend or terminate your access immediately, with or without notice, if we reasonably believe you:

• Violated these Terms or applicable law.
• Engaged in abuse, fraud, or circumvention of security or billing (including failed integrity or anti-abuse checks).
• Created risk or harm to us, other users, or third parties.

You may stop using the Service at any time. Provisions that by nature should survive (including licenses granted for operations already performed, disclaimers, limitations of liability, and dispute resolution) will survive termination.

9. Disclaimers

Some jurisdictions do not allow exclusion of certain warranties; in those cases, our disclaimers apply to the fullest extent permitted.

10. Limitation of liability

Nothing in these Terms limits liability where limitation is not permitted by law, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

If you are a consumer in the European Union or another jurisdiction with mandatory consumer protection rules, you retain all rights that cannot be waived by contract.

11. Indemnity

You agree to indemnify and hold harmless Honami from claims, damages, and expenses (including reasonable legal fees) arising from your content, your use of the Service, or your violation of these Terms or third-party rights, except to the extent caused by our intentional misconduct or where indemnity is prohibited by law.

12. Governing law and dispute resolution

12.1 Governing law

These Terms are governed by the laws of Slovakia, without regard to conflict-of-law rules, except where mandatory consumer protection laws of your country of residence provide otherwise.

12.2 Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms or the Service that cannot be resolved informally within 30 days of written notice to contact@dearpet.app shall be finally settled by binding arbitration, except where prohibited by mandatory consumer law.

• Seat of arbitration: Bratislava, Slovakia.
• Language: English.
• Rules: The arbitration shall be conducted under the rules of a recognized arbitration institution mutually agreed by the parties, or, failing agreement within 30 days, under the Rules of Arbitration of the Slovak Republic (or successor rules) before a single arbitrator.

Either party may seek injunctive relief in competent courts to protect intellectual property or prevent unauthorized access pending arbitration.

EU consumers: You may also bring claims in the courts of your country of residence where EU law grants you that right. Nothing in this section removes mandatory rights under EU consumer protection legislation.

13. App store terms

You acknowledge that Google is not a party to these Terms and is not responsible for the Service. Google Play’s terms and policies apply to downloads, updates, and billing.

14. Changes to these Terms

We may modify these Terms from time to time. We will post the updated version and revise the “Last updated” date. Material changes may be communicated through the app or Google Play listing where required. Continued use after changes become effective constitutes acceptance, except where applicable law requires explicit consent.

15. General

• Entire agreement: These Terms and the Privacy Policy constitute the entire agreement regarding the Service.
• Severability: If any provision is unenforceable, the remainder stays in effect.
• No waiver: Failure to enforce a provision is not a waiver.
• Assignment: You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or asset sale.
• Force majeure: We are not liable for delays or failures due to events beyond our reasonable control.
